PATENTS – Ateliers de la Haute-Garonne v. Broetje Automation USA Inc.

OPINION – Plaintiff sued for infringement of a device to deliver rivets through a pressurized tube. The district court found the patents invalid for failure to disclose the best mode for carrying out the invention. The appellate court reversed, finding that the best mode (known at the time) was disclosed; there was no requirement to point out which embodiment was the best mode. (Fed. Cir.)

COPYRIGHT - Eight Mile Style LLC v. Wieden + Kennedy Inc.

COMPLAINT - Musician “Eminem” claims that Facebook infringed copyright on song “Under the Influence” during a highly publicized event introducing “Facebook Home” and advertisement “Airplane.” (E.D. Mich.)

SECOND AMENDMENT - Brady Ctr. to Prevent Gun Violence v. City of Nelson

COMPLAINT - City ordinance requires every “head of household” to own a firearm and ammunition. Plaintiffs complain they are forced to do so against their will. (N.D. Ga.)

INTERNATIONAL TRADE - U.S. v. Adaptive MicroSystems LLC

OPINION AND ORDER - Court of International Trade applied Wisconsin law on liability of purchaser of company for existing unpaid import duties and penalties for misclassified imports of LED panels. Purchaser’s argument that it is not a mere continuation of the old company was rejected.(CIT)

HEALTH CARE – Sebelius v. Cloer

OPINION – Cloer brought a claim under the National Childhood Vaccine Injury Act, which allows an award of attorney fees to non-prevailing parties if their claim was in good faith and had a reasonable basis. Cloer’s claim was determined to be untimely, but the Supreme Court held that untimely petitions may qualify for attorney fees under the NCVIA. (U.S.)
